There are two basic paths to establishing spousal maintenance: by agreement or by trial.
The legal basis for establishing spousal maintenance is found in
RCW 26.09.090. These are
just some of the relevant factors that the court will consider:

  1. The financial resources of the party seeking maintenance, including the amount of
    property awarded to him in the division of property court order, and his ability to meet
    his needs independently;
  2. The time necessary to acquire sufficient education or training to enable the party
    seeking maintenance to find employment  appropriate to their skills, interests, style of
    life, and other attendant circumstances;
  3. The standard of living established during the marriage;
  4. The duration of the marriage;
  5. The age, physical and emotional condition, and financial obligations of the spouse
    seeking maintenance;and,
  6. The ability of the spouse from whom maintenance is being sought to meet his needs
    and financial obligations while meeting those of the spouse seeking maintenance.

These factors will also be considered in conjunction with the division of property and liabilities
ordered by the court and the order of child support. Spousal maintenance is a flexible tool
used by the court by which the divorcing couples' standard of living may be equalized for an
appropriate period of time.

Since the court has wide discretion and does not determine maintenance based on a formula
or standard calculation,  it is very important to have an experienced family law attorney
