DUI Criminal Charges
ARRAIGNMENT
The arraignment is your very first court appearance where the state formally charges you with
DUI. The arraignment is where you enter your plea of either guilty or not guilty. It is at this time
that the judge will set bail or your conditions of release. One example of the conditions of
release that the judge can impose is an Ignition Interlock Device for your vehicle pending the
outcome of your case. At the Law Offices of G. Parker Reich we are experienced at developing
strategies that can help minimize the conditions of release that can be imposed during your
arraignment.

PRETRIAL CONFERENCE
The next court appearance after your arraignment is your pretrial conference. At your first
pretrial conference you will receive (if you have not already) the state's evidence against you.
Once the state produces their evidence you are able to asses the strength of the their case.
We are experienced at analyzing the strengths and weaknesses of the prosecutions evidence
and spotting issues that could lead to a favorable outcome in your case.

PLEA BARGAINING
Once we have been able to analyze the state's evidence against you, we will begin to
formulate our litigation goals. If the state's case is relatively strong we may focus our attention
on seeking a plea for a lesser charge. If the state's evidence is weak our goals may be to seek
an outright dismissal of your case.

MOTION HEARINGS
Oftentimes the state's evidence on its face is relatively strong leaving us with very little
leverage to negotiate with. Through effective use of pretrial suppression motions we may be
able to suppress some of the state's evidence thus weakening their case and giving us more
bargaining power.

DEFERRED PROSECUTION
Deferred prosecution is a program where you petition the court to avoid a criminal conviction and administrative sanctions.  To qualify
for the program an individual must have a significant drug or alcohol mental health problem, attend two years of intensive treatment, and
successfully complete a three year probationary period following the treatment program. The deferred prosecution program is available
only one time in a persons lifetime and very demanding. Furthermore,  the consequences of not meeting the program criteria are
significant.

DUI TRIAL
A DUI trial is as complicated as any criminal trial. There is scientific evidence, forensic evidence, and typically the only witnesses are
professional witnesses that make a living testifying in court for the state. Drinking and driving is a very politically unpopular crime and
juries often come in with a bias against anyone charged with a DUI. Our job as DUI defense attorneys is to pick the right jurors, expose
the weaknesses in the state's evidence, and convince the jurors that you are not guilty beyond a reasonable doubt. To accomplish this
we must have a proven system for exposing unfavorable potential jurors and identifying those jurors that are willing to give you a fair
trial.  

To an untrained eye the states case against you may appear to be insurmountable. Frequently there are holes in the state's case, if you
know where to look. You need an attorney who understands the complexities of a DUI charge and is able to attack the deficiencies in the
prosecutions evidence.
